A club’s directors are ultimately responsible for the venue taking the right measures for the safety of all types of staff at the venue, says industry consultant Warren Tapp.

Directors are at the top of the ‘chain of responsibility’ for injury to anyone working within their business.

The “anyone” includes the following:
- All employees
- Apprentices, trainee or work experience people
- Contractors or sub-contractors
- Labour hire supplied workers
- All volunteers
Directors and management have obligations under the law of negligence to take reasonable care not to cause foreseeable harm to these people and to provide a safe and healthy work environment.
While each State or Territory has its own WHS laws, they are harmonised with the model WHS laws nationally. Breaches of such laws will result in prosecution, fines or other penalties for the company and its directors.
It is recommended the Board review all your current WHS policies and procedures, and both ask management for regular reports of any WHS incidents – and steps taken to minimise these risks.
